Trans child molester sentenced to two years in juvenile detention despite being an adult

Prosecutors say that Tubbs did not identify as female until she was taken into custody.

Hannah Tubbs, a 26-year-old transgender biological male, was sentenced to only two years in Juvenile Detention after pleading guilty to molesting a 10-year-old girl in 2014.

According to the Los Angeles Times, James "Hannah" Tubbs pleaded guilty to grabbing the 10-year-old girl by the throat in a Denny's bathroom, locked her in a stall, and put her hand down the girl's pants. Tubbs was also accused of sexually assaulting another young girl in a separate incident.

Prosecutors say that Tubbs did not identify as female until she was taken into custody.

Judge Mario Barrera heavily criticized LA District Attorney George Gascon for failing to file a motion to transger Tubbs into an adult criminal court, refusing to try her as an adult. Judge Berrera blamed Gascon's progressive policies for the unjust sentencing.

"I want to be clear," Barrera said during the Thursday sentencing, according to the LA Times. "The filing of a transfer motion is entirely within the discretion of the district attorney."

Kathryn Barger, chair of the Los Angeles County Board of Supervisors, slammed Gascon's refusal to try the repeat child sex predator in a statement on Thursday.

"Judge Barrera's hands were tied today – due to the fact that the DA's office failed to file a motion to transfer Tubbs to adult criminal court, which is where she rightly belongs," Barger said. "Instead, we're left with a 26-year-old individual sentenced to two years in a juvenile facility in isolation, separated by sight and sound from the other juveniles."

LA Deputy District Attorney Jon Hatami, assigned to the Complex Child Abuse Unit, slammed Gascon to Fox News for not caring about the suffering victims who have to live with the trauma.

"Tubbs is 26 years old. Unlike George Gascon's false narrative, she is not a 'kid,'" Hatami told Fox News.

"There was evidence presented at the juvenile proceedings which showed that Tubbs sexually assaulted two young girls in different incidents in the past. The child victims will suffer lifelong trauma. Tubbs also has prior violent convictions and conduct as an adult," Hatami explained.

LA District Attorney George Gascon has a history of refusing to prosecute, turning the criminal justice system into a revolving door for repeat violent offenders, because of his progressive policies.
