Special prosecutor urges Illinois Supreme Court to reject Jussie Smollett’s appeal

A special prosecutor has urged the Illinois Supreme Court to reject Jussie Smollett appeal in his conviction five counts of disorderly conduct in a hate crime hoax from 2021.

Smollett was convicted of lying to the police about a hate crime hoax and his legal team attempted to file a motion for an appeal in his case to the Illinois state supreme court. Dan Webb, the prosecutor of Smollett in the case, says that his appeals claim does not hold any water to be taken seriously.  

Smollett claimed he had previously struck a deal with the Cook County State's Attorney's Office where he could do community service, forfeit his bond, and then the prosecution would drop the charges.  

Webb said that this claimed deal was nothing more than "imaginary" and that Smollett does not understand how the legal system works. Webb also said that Smollett claimed he was a victim of double jeopardy, which would not apply in this case.  

In documents obtained by TMZ revealed on Monday, the special prosecutor pointed out that double jeopardy is "triggered only after the accused has been subjected to the hazards of trial and possible conviction." 

The overall point of the court documents, according to the outlet, was to drive home the point that Smollett's case is not worth the appeal and that Smollett should serve his 150-day sentence, of which he has only served 6 days so far.  

In December, after Smollett had appealed his conviction back in 2021 after serving 6 days in jail, he was supposed to head back to jail as the appeal court reached a conviction as well.  

The infamous race hoax, where he claimed that he was attacked by two white Trump supporters in Chicago who screamed, “This is MAGA country,” has become an example of racial hate hoaxes that have occurred in the United States.
