Texas AG sues Biden regime to block males from competing in women's sports

On Wednesday, Texas interim attorney general John Scott filed a lawsuit against the Biden administration over their proposed changes to Title IX. The new interpretation said that sex-based discrimination also applies to sexual orientation and gender identity. 

In 2021, the Texas legislature passed a law that bans males from competing in female sports in K-12 education. The Biden administration's expansion is in direct opposition to the state law and puts all Texas schools at risk of losing federal funding. 

In a statement, the attorney general's office said, "Texas is challenging this blatant attempt to misuse federal regulatory power to force K-12 schools, colleges, and universities in our state to accept and implement ‘transgender’ ideology. — in violation of state law — by misusing the Title IX statute to threaten the withholding of federal education funds.”

“The Administration’s unlawful guidance could put at risk over $6 billion in federal funding that supports Texas K-12 and higher education institutions,” The statement concluded. 

The lawsuit seeks to block the proposed changes to include gender identity and sexual orientation in Title IX.

According to the Texas Tribune, the Texas legislature passed Senate Bill 15 this year, also known as the "Save Women's Sports Bill," which bans males from competing in female sports at the college level as well. Gov Greg Abbot announced he plans to sign the bill this week. 

In April, the administration announced a proposed change to Title IX that forces states to allow transgender athletes to compete in the sports category that aligns with their gender identity rather than their sex. 

"The proposed rule affirms that students benefit from the chance to join a school sports team to learn about teamwork, leadership, and physical fitness. The proposed rule would establish that policies violate Title IX when they categorically ban transgender students from participating on sports teams consistent with their gender identity just because of who they are," the Department of Education said at the time. 

It said these bans "fail to account for differences among students across grade and education levels." The statement continued, "different levels of competition—including no-cut teams that let all students participate," and "different types of sports."

The Biden Administration cited the 2020 Bostock v. Clayton County Supreme Court ruling, which said, "Discrimination based on sexual orientation or gender identity is sex discrimination under Title VII of the Civil Rights Act of 1964."

The Department of Education is expected to release the final Title IX changes in October 2023.
