The prosecution is expected to present evidence showing that there is probable cause to try Robinson for the murder, including pre-recorded testimony from Robison's trans former lover Lance Twiggs. This is evidence that Robinson's defense attempted to have suppressed, arguing that it was "hearsay."
Robinson, say prosecutors, left a note for Twiggs saying "I had the opportunity to take out Charlie Kirk, and I’m going to take it." He is also reported to have told people that he was "sick" of Kirk's "hate."
His parents and sister will also be there. They released a statement, saying "Charlie was a beloved husband, son, brother, friend, and father. Every court proceeding serves as a painful reminder of his death and the loss that has irrevocably impacted our lives and the lives of his children.
"We remain deeply grateful for the support, prayers, and kindness we have received. This outpouring has sustained us during the darkest days of our lives. Out of respect for the judicial process, we will not be commenting further at this time. We ask for continued privacy as we navigate this process and immense grief."
The preliminary hearing is necessary before the case can move to a trial. Robinson has not yet entered a plea. In this case, prosecutors charged Robinson "by information," which necessitates a preliminary hearing, where a grand jury indictment could not. The defense attorneys will be able to cross examine witnesses and the prosecution will be able to make their case that there is probable cause to move ahead.
The defense has attempted to create delay after delay in the case, arguing that the Utah County prosecutors office should be removed from the case because the daughter of one of the attorneys was among the 3,000 at Utah Valley University on that day. They've attempted to have the prosecutors held in contempt for speaking to press after media took a defense motion and claimed that it said the bullet used to kill Kirk were not a match for Robinson's gun. The ballistics report had said that the bullet came from a gun like Robinson's.
Attorneys for Robinson have also sought to have cameras removed from the courtroom and to limit press access. Press access to evidence has been limited, but Judge Graf has allowed cameras to be in the court room. Those camera operators are not permitted to film Robinson in shackles.
Expected evidence includes forensic analyses, surveillance video, recordings of witness statements, findings from the autopsy report, and digital communication between Robinson and his friends in which he admits to killing Kirk.
Erika Kirk posted a statement on behalf of herself, the Kirk's immediate family, his parents Robert and Kathryn, and his sister, Mary:
